Permit Navigation: LCP, CDP, and City of Malibu Approvals

Getting permits for a luxury home rebuild after fire in Malibu requires coordinating with multiple departments and agencies. PaliPM is responsible for the entire permitting process; the following are just a few:

  • Preparation & submission of Planning Verification Form (PVF) or Administrative Plan Review (APR) via Malibu Development Portal.
  • Contacting the City of Malibu’s Community Development Department to coordinate with the City.
  • Wherever slope, bluff or flood zone issues occur, there will be a need to coordinate with geotechnical or coastal engineering.
  • Identify the key elements of OWTS design and permit, and review the process with the County Environmental Health.
  • A review of land encroachment permit applications for those that have PCH or state road access.
  • Homeowners who are planning any type of Site Plan Review or CDP process, aside from like-for-like, will be required to submit their plans for management.
  • Tracking noticing periods, appeal periods and plan-check correction periods

LCP, CDP, and City of Malibu Approvals

Coordinate between the Architect, Engineer and Contractor.

Fire rebuild in Malibu, CA will require a larger professional team than would most residential fire rebuild projects in the world. In addition to a general contractor, most rebuilds will need a structural engineer, geotechnical engineer, coastal engineer (for properties that are close to the shoreline or bluff) and a licensed architect that is knowledgeable about the requirements of LCP design; in some instances, a landscape architect will also be required to address fire safety vegetation standards.

PaliPM takes care of such relationships for you. We define the scope, review the proposals and set milestones on the project and hold all members of the team accountable to the schedule and budget. We are always your representative and not the coordinator that has the vendors’ interests at heart.

Construction Oversight and Quality Control

As construction starts, day-to-day management is the key to success or failure of rebuilds. PaliPM offers construction management services on-site for all aspects of the project, including foundation inspection, framing, mechanical, electrical, plumbing rough-in and final finishes. We verify work is in line with approved work plans, inspections are planned and passed and changes are reported and approved in advance of disputes.

For Luxury home reconstruction in Malibu, meticulous oversight, especially when dealing with the nuances of finishes, material choices, and custom components. In Malibu, where finishes, materials, and customization are essential to every home, this is not a luxury but a necessity for quality over the top. It is the difference between a home that’s a reflection of what you wanted and an easy home for your contractor to construct.

Why Malibu Homeowners Choose PaliPM

PaliPM is NOT a contractor. We are not involved in the construction of your home. We work only for you.

That’s important in Malibu, more than any other place in Los Angeles, as all the people you’ll work with during your rebuild, from contractors to architects, coastal engineers to consultants have their own business interests. It is a conflict a project manager as a contractor has. There is only one person that an owner’s representative will serve; you.

Our staff has combined real estate development and construction management experience of decades on all of our projects. We are local. We understand the issues of planning in the City of Malibu, the Coastal Commission’s procedures, and we understand how to build in canyon and coastal terrain. We have been able to accommodate complex and high dollar residential projects in this very environment.

And we’re open and honest. We charge a fixed amount, it is always communicated beforehand. No referral fees are paid to us from contractors/vendors. All of the recommendations that we make are for your benefit.

A Coastal Development Permit will be required in the following situations

If a homeowner wishes to rebuild more than 10% larger, change the location of the structure on the lot or modify the structure in a way that is not considered “like-for-like”, a Coastal Development Permit (CDP) must be applied for. In addition to the higher planning fees, the mandatory public noticing periods for CDPs, and in some cases, review by the California Coastal Commission itself in appeal zone areas, CDPs require significantly more resources than other permitted uses of the coastal zone.

Even if they have been built without permits, ADUs may be able to be legalized using the CDP process — something to consider when deciding on the scope of a rebuild.

The Fee Waiver Program

The City of Malibu has implemented a fee waiver program for Malibu homeowners who lost or lost part of their primary residence in the Palisades Fire, Franklin Fire or Broad Fire. The deadline for applying for waivers is June 30, 2028, and only for permits that are pulled until the end of 2030. If you qualify and document this waiver properly, you can save the homeowner thousands of dollars, and PaliPM assures that nothing falls through the cracks.

What Malibu Homeowners Are Actually Dealing With Right Now

The City of Malibu issued its first rebuilding permit, seven months after the Palisades Fire. Dozens of planning approvals have already been granted and applications are currently in the permitting process, but for the majority of Malibu homeowners, it’s early to mid-stage permitting, design development, and/or awaiting debris clearance confirmation.

The challenges are real and they are specific:

  • Permit pipeline competition.

A number of hundreds of rebuild applications are currently in the City’s processing. Well-documented and well-done properties with full submissions and follow-up sell sooner. Rejected submittals are held until they are completed or “reactivated”.

  • Contractor availability.

There are very few licensed contractors with experience in the City’s planning department and working with coastal engineers, in particular, who have long experience with Malibu. It’s important that homeowners hire a qualified owner’s representative at the outset so they can rest assured they will hire the right team even before they’ve sold their homes.

  • Insurance timeline pressure.

Extended timeframes allowed under California Insurance Code, but also internal processes, and incentives of insurance companies. Homeowners frequently take settlements that are less than what it is really going to cost to rebuild their house following a Malibu fire, without any representation for them.

  • Decision fatigue.

From design decisions to permit pathway trade-offs, to hiring a contractor to choosing materials, there are myriad decisions to make for every phase of a rebuild. When homeowners make decisions on their own, they tend to make poor choices when they are pressed for time. PaliPM is the structure and support that ensures informed and on-track decisions.
